Any foreign employer who wishes to hire manpower from India (skilled labor/unskilled labor / semi-skilled labor) is required to undergo a registration process with Indian Embassy (in respective country) and the “Emigrate” system of Ministry of External Affairs Government of India. This is especially applicable for all countries where “Emigration” clearance is needed for ECR passport holder who is traveling for employment purpose. Although the process is very simple and does not take much time, however, the online registration, submission of documents in Embassy and the visit of Embassy official (if needed) should be completed before permission is granted.

After the permission is granted a new login is created for the foreign employer wherein the “FE” company can select the recruitment agency from the list of approved and licensed Agencies list which is updated regularly by the MEA.

Once this process is done, then each and every document thereafter is generated online. For example, the demand letter the POA( power of attorney) and the specimen contract all documents are generated online. In some cases, a print of same on letterhead and sign is required to be uploaded to the portal to facilitate the further process.

This system in a way has eliminated much of paperwork which was needed earlier and also the physical movement of passport of candidates for Emigration clearance.

Further, the Indian Embassy takes cognizance of workers complaints if any about the “foreign employer” and can take suitable action or block the login in case of any serious complaints from the workers. Similarly, if any complaints lodged against the agency for unfair practices the same may face action from the MEA and can be blocked from clearing further passports for Emigration.
